There are two types of EPOAs – Property and Care & Welfare. The EPOAs allow your nominated person/people (called “donee(s)”) to look after you and your affairs if you become mentally incapable (or you can elect for your donee(s) to act now). You should prepare both EPOAs at the same time. Without the EPOAs, it is a daunting task, costly and time-consuming, for your family/friend to apply through the Family Court for an appointment.
The Ministry of Justice has published the prescribed forms which you can complete by yourself but you still need a lawyer or approved person to certify your signature and explain the effects and implications to you.
How to prepare your Enduring Power of Attorney (“EPOA”)
STEP 1: Read the standard explanations of both EPOAs (click on the link) – standard explanations for Care & Welfare and Property
STEP 2: Download Care & Welfare and Property forms and complete these by hand or electronically. Please ensure you complete every applicable section of the forms or we may charge additional to help you with those.
STEP 3: Email the completed forms to eva@psalmslaw.co.nz together with a copy of your and your donee(s)’ passport(s). We will make an appointment to see you and your donee(s). Cost is approximately $200-$800 (GST inclusive). We may ask for a proof of mental capacity depending on our assessment of your situation before the EPOAs can be certified.
